These Terms and Conditions ("Terms") govern your use of the Forresso website at https://forresso.com (the "Website") and your purchase of our products. Please read them carefully. By using the Website or placing an order, you agree to be bound by these Terms, our Privacy Policy and our Shipping, Return and Cancellation Policy. If you do not agree, please do not use the Website.
1. About Us
The Website is operated by Forresso, a partnership firm based in Bengaluru, India ("Forresso", "we", "us", "our"). Our address and contact details are in Section 15.
2. Eligibility and Accounts
- You must be at least 18 years old to place an order on the Website.
- If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Please tell us immediately if you suspect unauthorised use.
- You agree to give current, complete and accurate information when you register or place an order (including your name, email address, phone number and delivery address), and to update it if it changes, so that we can complete your orders and contact you when needed.
3. Products and Product Information
- Images and colours: we try to show our products and their colours as accurately as possible. We cannot guarantee that your screen will display colours exactly as they appear in real life.
- Natural ingredients: our products are formulated with plant-based and natural ingredients, along with other active ingredients. Slight variations in colour, texture or fragrance may occur between batches. These variations are normal for products of this type.
- Ingredients and allergies: please read the ingredient list on each product page and on the packaging before use. If you know you are allergic or sensitive to any ingredient, do not use the product.
- Patch test: we recommend doing a patch test before using any new product. Stop use if you experience irritation, and consult a doctor if the reaction continues. See Section 10 of our Shipping, Return and Cancellation Policy for how to tell us about a reaction.
- Not medical advice: our products are cosmetic products. They are not intended to diagnose, treat, cure or prevent any disease, and information on the Website is not medical advice. If you are pregnant or breastfeeding, have a skin condition, or are under medical care, please speak to your doctor before starting a new product.
- Results vary: individual results depend on factors such as skin or hair type, how regularly the product is used, and lifestyle, so results differ from person to person.
4. Pricing, Taxes and Order Acceptance
- All prices are in Indian Rupees (₹). The price shown for a product is the price you pay for it, and shipping charges, if any, are shown at checkout before you pay. Shipping is free on orders of ₹499 and above; a flat shipping charge of ₹60 applies to orders below ₹499.
- Prices may change from time to time. The price shown when you place your order is the price you pay for that order.
- Despite our care, a product may occasionally be listed at the wrong price or with other errors. If this happens, we may cancel the order and give you a full refund.
- Placing an order is an offer to buy. We accept it when we dispatch your order. We may refuse or cancel an order, for example if a product is out of stock, your pincode cannot be served, or we suspect fraud. If we cancel a paid order, we will refund you in full.
- We may change or discontinue any product at any time.
- If we offer discount codes or promotions, they are subject to the conditions shown with the offer and cannot be exchanged for cash.
5. Payments
- Pay online at checkout using UPI, cards or net banking. Cash on Delivery is not available.
- Payments are processed by our payment gateway, Cashfree Payments. We do not store your card, bank or UPI details.
- By placing an order, you confirm that you are authorised to use the payment method you choose.
6. Shipping, Returns, Refunds and Cancellation
Our Shipping, Return and Cancellation Policy forms part of these Terms. In summary, we ship within India through India Post, and we accept returns only for damaged, defective, wrong, missing or expired products, subject to the conditions in that policy. If these Terms and that policy differ on a shipping, return, refund or cancellation matter, that policy applies.
7. Customer Reviews and Content
If you post a review, comment or photo on the Website, you confirm that it is truthful and that you own it or have the right to share it. You allow us to display and use it on the Website and in our marketing, free of charge, without payment to you. We may remove any content that is false, abusive, unlawful or misleading, or that infringes someone else's rights.
8. Acceptable Use
You agree not to:
- use the Website for any unlawful or fraudulent purpose;
- attempt to gain unauthorised access to the Website, its systems or other users' accounts;
- introduce viruses or harmful code, or disrupt the Website;
- copy data from the Website using automated tools without our written permission; or
- place orders for resale without our written permission.
9. Intellectual Property
All content on the Website, including the Forresso name, logo, text, images, product descriptions, product information and design, belongs to Forresso or is used with permission, and is protected by intellectual property laws. You may view and share links to the Website for personal use, but you may not copy, reproduce, modify or use our content for commercial purposes without our written permission.
10. Third-Party Links and Services
The Website may link to third-party websites, including social media pages, and relies on third-party services such as payment and courier providers. We do not control these third parties and are not responsible for their content, policies or services.
11. Website Availability
We try to keep the Website available and error-free, but we do not promise that it will always be uninterrupted or free of errors. We may suspend or change the Website for maintenance or other reasons.
12. Limitation of Liability
To the fullest extent permitted by law, Forresso is not liable for any indirect, special or consequential loss arising from your use of the Website or our products, or from being unable to use them. Our total liability for any claim relating to a product is limited to the amount you paid for that product.
Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited, including liability for fraud, or for death or personal injury caused by our negligence, or any rights you have under applicable consumer protection laws.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Subject to the next sentence, the courts at Bengaluru, Karnataka have jurisdiction over any dispute relating to these Terms. Nothing in this clause limits your right to approach a consumer forum or any other authority that has jurisdiction under applicable consumer protection law.
14. Changes and General Terms
- We may update these Terms from time to time. The "Last updated" date at the top shows when they were last changed. The Terms published on the Website when you place an order apply to that order.
- If any part of these Terms is found to be unenforceable, the rest remain in effect.
- Our failure to enforce any part of these Terms is not a waiver of our rights.
